User Agreement
1. General Provisions
1.1. This User Agreement (hereinafter referred to as the "Agreement") governs the use of the Zenith Boutique Studio mobile app, the zenithfitness.ge website, and related digital services (hereinafter collectively referred to as the "Services").
1.2. By installing and/or using the App, the user confirms that:
• they have read this Agreement and the ZenithfitnessPrivacy Policy;
• they agree to their terms;
• they have sufficient legal capacity and efficiency to enter into the Agreement.
1.3. If the user does not agree to the terms of the Agreement, they must stop installing and using the App and delete it from their device.

3. Age Restrictions
3.1. The App is intended primarily for users over 14 years of age.
3.2. Registration and use of the App by persons under 14 years of age is permitted only with the consent of a legal guardian and/or within the framework of children's programs stipulated by the Studio's rules. The legal guardian is responsible for the actions of minor users.
4. Purpose and Functionality of the App
4.1. The App is intended for:
• Signing up for training sessions, treatments, and events;
• Viewing the schedule and information about the studio's services;
• Communicating with Zenithfitness representatives;
• Accessing wellness content (materials, news, general recommendations);
• Receive notifications about bookings, schedule changes, promotions, and special offers.
4.2. The functionality of the App may be changed, supplemented, or limited by the Operator without prior notice to the user, subject to applicable laws.
5. User Account
5.1. To use certain features of the Application, the User may create an account by providing the required information.
5.2. The User undertakes to:
• provide accurate and current information;
• promptly update this information when it changes;
• not share login information with third parties and ensure the confidentiality of their authorization information.
5.3. The User is responsible for all actions performed in the Application using their account.
5.4. The Operator reserves the right to restrict the User's access to the Application, temporarily block, or delete their account in the following cases:
• violation of the Agreement or Privacy Policy;
• commitment of fraudulent activity, bonus abuse, hacking attempts, or unauthorized access;
• dissemination of spam, insults, objectionable content, or other actions that violate the rights of third parties.
6. Registration, Services, and Studio Rules
6.1. Using the App to register for training sessions, treatments, or events does not automatically constitute a service agreement. The agreement is considered concluded upon confirmation of the registration by the studio (via the App, phone call, SMS, email, or other means).
6.2. The terms of service (price, duration, format, health and fitness requirements) are determined by the current price list and internal rules of Zenithfitness Studio.
6.3. The rules for registering, rescheduling, and cancellingclasses, as well as possible penalties for late cancellation or no-show, are published:
• in the App in the relevant section;
• and/or on the zenithfitness.ge website.
• The User undertakes to familiarize themselves with these rules before registering.
7. Medical Disclaimer
7.1. The materials in the App, including text, videos, images, training programs, and recommendations, are for general informational and wellness purposes only and do not constitute medical advice or replace a doctor's consultation.
7.2. Before beginning workouts or treatments, the user is obligated to independently assess their health and, if they have chronic illnesses, injuries, pregnancy, or other medical conditions, consult a doctor.
7.3. The user undertakes to inform the studio's specialists of their health limitations and follow their recommendations regarding exercise load and technique.
7.4. Zenithfitness is not liable for any harm to health resulting from:
• the user's concealment of health information;
• failure to follow specialist recommendations;
• independently changing the intensity of exercise contrary to recommendations.
8. Personal Data and Privacy
8.1. The processing of the user's personal data is carried out in accordance with the Zenithfitness Privacy Policy and Law of Georgia on Personal Data Protection.
8.2. The text of the Privacy Policy is available on the zenithfitness.ge website and in the relevant section of the App.
8.3. By using the App, the user agrees to the terms of personal data processing set forth in the Policy.
9. Photography and Videography
9.1. Photography and videography may be conducted on the studio premises for security purposes, event documentation, and the creation of marketing materials.
9.2. The use of photos and videos featuring the user for advertising and informational purposes is subject to the user's consent, which may be revoked at any time in accordance with the procedures set forth in the Privacy Policy.
10. Intellectual Property
10.1. All rights to the Application and its content belong to the Operator or are legally used. These include:
• software code, design, and interface;
• text, images, photos, videos, and audio;
• training programs, methods, and materials;
• trademarks, logos, and other unique features.
10.2. The User receives a limited, non-exclusive, non-transferable license to use the Application on their device solely for personal, non-commercial purposes.
10.3. The User is prohibited, without the Operator's written consent to:
• copy, distribute, modify, decompile, or reverse engineer the Application;
• use the Application materials for commercial purposes;
• transfer rights to use the Application to third parties, except as directly provided by law.
11. Limitation of Liability
11.1. The App and its functionality are provided "as is" without any direct or implied warranties of uninterrupted operation, satisfaction of user expectations, or suitability for a particular purpose, to the extent permitted by Georgian law.
11.2. Zenithfitness is not liable for:
• temporary unavailability of the App due to maintenance, network issues, or actions of third parties;
• any direct or indirect damages to the user arising from the use or inability to use the App;
• user decisions and actions based on information obtained through the App, including training and wellness recommendations.
12. Relationship with the App Store and Google Play
12.1. The User acknowledges and agrees that:
• Apple Inc. and Google LLC (and their affiliates) are not parties to this Agreement;
• the Operator is solely responsible for the content, support, and operation of the Application;
• all claims related to the Application are addressed directly to the Operator, not to Apple or Google.
12.2. For Apple device users:
• Use of the Application is governed by this Agreement and Apple's standard end user license agreement (Apple Media Services / Standard EULA), unless otherwise provided by applicable law;
• in the event of any conflict between the terms of this Agreement and Apple's mandatory terms, Apple's mandatory terms shall apply to the extent of such conflict.
12.3. For Android device users:
• Use of the Application is subject to the Google Play rules and applicable law;
• the terms of this Agreement shall apply to the extent they do not conflict with Google Play's mandatory terms.
13. Amendments to the Agreement
13.1. The Operator reserves the right to unilaterally amend this Agreement. The current version is posted in the App and on the zenithfitness.ge website.
13.2. Continued use of the App after changes have been made constitutes the user's consent to the updated version of the Agreement.
14. Applicable Law and Dispute Resolution
14.1. This Agreement is governed by Georgian law.
14.2. Disputes arising from the use of the App shall be resolved in the courts of Tbilisi in accordance with the procedural rules of Georgia.
